Representing Qualcomm vs. Apple Computer Trading Shanghai Company in the administrative litigation second instance of the invalidation case of the invention patent related to "Card Metaphor in Computing Devices" (selected as Case 72 of the "100 Typical Cases of the Fifth Anniversary of the Establishment of the Intellectual Property Court of the Supreme People's Court", Case 45 of the "50 Typical Intellectual Property Cases of the Chinese Court in 2022", and Case 9 of the "20 Typical Cases of the Intellectual Property Court of the Supreme People's Court in 2022");

• The patent holder of Qualcomm's invention patent number 201310491586.1, titled "Active Card Metaphor in Computing Devices". Apple Computer Trading (Shanghai) Co., Ltd. submitted a request for invalidation to the China National Intellectual Property Administration, and the China National Intellectual Property Administration decided to maintain the validity of the patent right. Apple Computer Trading Shanghai Company is dissatisfied and has filed a lawsuit with the Beijing Intellectual Property Court. The first instance court ruled to reject his lawsuit request. Apple Computer Trading Shanghai Company disagrees and files an appeal. The Supreme People's Court held in the second instance that if several technical features in a technical solution are interdependent and have a synergistic effect, and can rely on the whole to achieve a certain function and produce corresponding effects, then the above-mentioned synergistic effect should be considered in the creative evaluation.
