Professional Profile

Du Hongkai possesses dual qualifications as a Patent Attorney and a practicing lawyer, with hands-on experience in technical development. Since beginning his legal practice, he has been deeply involved in intellectual property and civil/commercial cases. He later served as in-house legal counsel for a central state-owned enterprise, gaining extensive practical experience in IP management, patent portfolio planning, infringement risk assessment, and compliance. He is currently a lawyer at Ruoshan Law Firm. Du excels at integrating technical, legal, and business perspectives to assist clients with patent filing, protection, and dispute resolution. He also provides day-to-day legal services such as patent risk analysis and brand/trademark protection. The industries he serves include machinery, electric power, new energy, computers, and the internet.

Key Achievements

  • Represented a technology company in a utility model patent infringement dispute concerning a "data interface." By comparing the technical features, it was determined that the accused product did not fall within the protection scope of the patent, helping the client avoid liability for compensation.
  • Represented a machinery company in responding to a patent invalidation request against a "fixture" patent. By submitting prior art evidence, successfully maintained the patent partially valid.
  • Represented a client in a labor dispute case. After unfavorable results at the arbitration stage and a loss at the first-instance trial, the client retained the lawyer. The case then went through a second-instance remand for retrial, followed by another second-instance proceeding. Subsequently, the lawyer filed a retrial application on behalf of the client, and the High People's Court agreed to hear the case by retrial and reversed the judgment in favor of the client, achieving a desirable outcome.
  • Represented a software development company in a contract dispute. The client, as a technical service provider, was sued for breach of contract. By reviewing performance records and communication evidence, it was demonstrated that the other party had breached the contract first. The case was ultimately resolved through mediation, and the client did not have to pay any compensation.
  • Represented a technical professional in a non-competition dispute. The employer claimed a high amount of liquidated damages. By arguing that the technical professional did not fall within the statutory scope of non-compete obligations and that the former employer had not paid economic compensation, the court ultimately dismissed all of the other party's claims.
